These conditions of sale are concluded on the one hand by the company hereinafter called "VAVAIA" and on the other hand, by any natural or legal person wishing to make a purchase via the website of " vavaia.fr " named herein. -after “the buyer”.

Object

These conditions of sale aim to define the contractual relations between VAVAIA and the buyer and the conditions applicable to any purchase made through the merchant site of vavaia.fr .

The acquisition of a property through this site implies unreserved acceptance by the buyer of these conditions of sale.

These conditions of sale will prevail over any other general or specific conditions not expressly approved by VAVAIA.

VAVAIA reserves the right to modify its conditions of sale at any time. In this case, the applicable conditions will be those in force on the date of the order by the buyer.

Characteristics of the goods and services offered

The products offered are those which appear in the catalog published on the VAVAIA website.

These products are offered while stocks last.
Each product is accompanied by a description established by the supplier.

The photographs in the catalog are as faithful as possible but cannot ensure perfect similarity with the product offered, particularly with regard to the colors.

Prices

The prices appearing in the catalog are inclusive of VAT in euros, taking into account the VAT applicable on the day of the order; any change in the rate may be reflected in the price of the products or services.

VAVAIA reserves the right to modify its prices at any time, it being understood, however, that the price appearing in the catalog on the day of the order will be the only one applicable to the buyer.

The prices indicated do not include order processing, transport and delivery costs as well as customs costs as long as they take place in the geographical areas provided below.

Orders

Before any order, if desired, the buyer can create an account on the VAVAIA website. The account creation section is accessible directly from the side menu bar. At each visit, the buyer, if he wishes to order or consult his account (order status, profile, etc.), must identify himself using this information.

The VAVAIA company offers the buyer the opportunity to order and pay for their products in several stages, with a single payment option: payment by credit card, made through the secure system which uses the SSL (Secure Socket Layer) protocol.

Confirmation of the order entails acceptance of these conditions of sale, acknowledgment of having perfect knowledge of them and waiver of the right to rely on one's own conditions of purchase or other conditions.

All the data provided and the recorded confirmation will constitute proof of the transaction. Confirmation will be worth signing and acceptance of transactions.

The seller will communicate confirmation of the registered order by email to contact@vavaia.fr .

Orders are prepared quickly, so changes upon customer request cannot be accepted. However, the customer can contact our customer service team at contact@vavaia.fr who will do their best to respond to the customer's request.

Payment terms

The price is due when ordering.

Payments will be made by credit card; they will be carried out through the secure system which uses the SSL (Secure Socket Layer) protocol so that the information transmitted is encrypted by software and no third party can become aware of it during transport on the network.

The buyer's account will be debited when placing an order for available products and the amount of products sent.

At the buyer's request, he will be sent an invoice showing VAT.

Deliveries

Deliveries are made to the address indicated in the order form which can only be in the agreed geographical area.

Deliveries are made by Mondial Relay (delivery to a relay point) or DHL (home delivery).

Packages are shipped within 2 to 8 days.

Standard delivery (France): 3 to 10 working days after shipping, depending on the carrier's deadlines.

In the event of damage during transport, the complaint must be made to customer service within three days of delivery.

VAVAIA cannot be held responsible for external factors that may delay or prevent delivery and which are not covered by our logistics partners. Delivery times are given for information purposes only; if these exceed thirty days from the order, the sales contract may be terminated and the buyer reimbursed.

VAVAIA is not responsible for packages disappearing from your mailbox after official delivery recorded by the carrier. Once your package is declared delivered, our responsibility is no longer engaged. No refund will be made in this case.

The buyer is required to check, in the presence of the delivery person or the relay point manager, the condition of the packaging of the goods and its contents upon delivery. In the event of damage during transport, any protest must be made to the carrier within three days of delivery.

The complaint of a missing item in an order must be transmitted to VAVAIA the same day of receipt of the package. After validation by customer signature, no complaints will be possible.

Withdrawal

Under article L121-20 of the Consumer Code, the buyer has a period of fourteen working days from receipt of their order to exercise their right of withdrawal and thus return the product to the seller for refund without penalty, with the exception of shipping and return costs, payable by the buyer.

Warranty & Complaints

For any complaints about your order, please contact customer service by email at contact@vavaia.fr within a maximum period of 72 hours upon receipt of your package.

All products supplied by VAVAIA benefit from the legal guarantee provided for by articles 1641 et seq. of the Civil Code.

In the event of a declaration of non-conformity of a product received within 72 hours, the customer may request a refund from VAVAIA.

In the case of a product under warranty (3 months), VAVAIA reserves the right to refuse the buyer's request in the event of deterioration of the jewelry due to the use made of it (scratches, rust, oxidation, loss of shine …).

This guarantee nevertheless covers any manufacturing defect (detached pearls and stones, broken chains, defective clasps, etc.). A credit note can then be sent to the buyer, with unlimited validity on the VAVAIA website.

Any claim for an order will be impossible beyond 90 days from the date of receipt.

Refund

In the event of withdrawal, refunds are made within the days following receipt of your package in the logistician's warehouse.

Beyond 180 days, the PayPlug banking organization which manages banking transactions will no longer be able to issue a refund. Your item will then be compensated in the form of a credit.

International & Taxes

The online sale of products presented on the site is reserved for buyers who reside in France, and in the other countries cited HERE (link to fdp FAQ).

In the event of delivery of a product outside the territory of the European Union and in the French Overseas Territories, the Buyer declares itself the importer of the product and accepts that in such a case VAVAIA may be physically unable to provide him with exact information on the total amount of costs relating to customs duties and formalities or import taxes applicable in the country where delivery of the product is requested.

Unless otherwise stated on the site during the order process or in the description of the products ordered, VAVAIA undertakes in all cases to deliver the products within a maximum period of thirty (30) days after the conclusion of the contract with the Buyer.

Responsibility

The VAVAIA company, in the online sales process, is only bound by an obligation of means. It cannot be held liable for damage resulting from the use of the Internet network such as loss of data, intrusion, viruses, interruption of service, or other unintentional problems.

Intellectual property

All elements of the VAVAIA site are and remain the intellectual and exclusive property of VAVAIA.

No one is authorized to reproduce, exploit, redistribute, or use for any reason whatsoever, even partially, elements of the site, whether software, visual or sound.

Any simple or hypertext link is strictly prohibited without the written consent of VAVAIA.

The VAVAIA brand as well as all figurative or non-figurative brands and more generally all other brands, illustrations, images and logos appearing on the Goods, their accessories and their packaging, whether registered or not, are and will remain the property exclusive to VAVAIA.

Any total or partial reproduction, modification or use of these brands, illustrations, images and logos, for any reason and on any medium whatsoever, without the express prior consent of VAVAIA, is strictly prohibited. The same applies to any combination or conjunction with any other brand, symbol, logo and more generally any distinctive sign intended to form a composite logo. The same applies to any copyright, design, model and patent which are the property of VAVAIA. In addition, all designs and visuals of which VAVAIA is the author, that is to say, created by VAVAIA internally, may only be used exclusively by VAVAIA.

Personal data

In accordance with the law relating to data processing, files and freedoms of January 6, 1978, personal information relating to buyers may be subject to automated processing.

VAVAIA reserves the right to collect information about buyers, including by using cookies, and, if it wishes, to transmit the information collected to commercial partners.

Buyers may object to the disclosure of their contact details by notifying VAVAIA.

Likewise, users have a right of access and rectification of data concerning them, in accordance with the law of January 6, 1978.

The automated processing of information, including the management of e-mail addresses of users of the site, has been declared to the CNIL.

Archiving - Proof

VAVAIA will archive purchase orders and invoices on a reliable and durable medium constituting a faithful copy in accordance with the provisions of article 1348 of the Civil Code.

VAVAIA's computerized records will be considered by the parties as proof of communications, orders, payments and transactions between the parties.

Litigation

These conditions of online sale are subject to French law.

In the event of a dispute, jurisdiction is assigned to the competent courts of Paris, notwithstanding multiple defendants or warranty claims.
